PLEASE TAKE NOTICE that on October 20, 2016, at 8:00 a.m., before the Honorable Mary A. Yunker, Judge of District Court, at the Sherburne County Government Center, 13880 Business Center Drive N.W., Elk River, Minnesota, the Petitioner will present to the above-named court its Amended Petition and Motion for an Order Authorizing Transfer of Title and Possession Pursuant to Minn. Stat. § 117.042 (“Amended Petition”) for the condemnation of certain real estate interests, in Sherburne County, Minnesota, as further described in Exhibit A to the Amended Petition.
The Amended Petition is on file in the Office of the District Court Administrator for Sherburne County, at the Sherburne County Government Center, 13880 Business Center Drive N.W., Elk River, Minnesota.
The Petitioner has also requested the appointment by the court of three commissioners to ascertain and report the damages that will be caused by the taking of said real estate interests.
YOU ARE FURTHER NOTIFIED that a party wishing to challenge the public use or public purpose, necessity, or authority for a taking must appear at the court hearing and state the objection. A court order approving the public use or public purpose, necessity, and authority for the taking is final unless an appeal is brought within 60 days after service of the order on the party.
YOU ARE FURTHER NOTIFIED that at the same time and place stated above, pursuant to Minn. Stat. § 117.042, Petitioner will move the court for an order authorizing the early transfer of title and possession of the real estate interests described in the Amended Petition, effective as of September 22, 2016.  At the hearing on October 20, 2016, the Petitioner will bring before the Court a motion asking for an order permitting the Petitioner to pay to the Respondents or deposit into Court an amount equal to the approved appraised value of the subject real estate interests, thereby transferring title and the right to possession of the real interests to the Petitioner as of the dates specified in the order.
Neither payment to the Respondents nor deposit into Court of the amount as stated above shall prejudice or affect the right of Respondents to contend for further payment in this proceeding.

YOU ARE FURTHER NOTIFIED that a party wishing to challenge the public use or public purpose, necessity, or authority for a taking must appear at the court hearing and state the objection. A court order approving the public use or public purpose, necessity, and authority for the taking is final unless an appeal is brought within 60 days after service of the order on the party.

Stat. § 117.042, Petitioner will move the court for an order authorizing the early transfer of title and possession of the real estate interests described in the Amended Petition, effective as of September 22, 2016.  At the hearing on October 20, 2016, the Petitioner will bring before the Court a motion asking for an order permitting the Petitioner to pay to the Respondents or deposit into Court an amount equal to the approved appraised value of the subject real estate interests, thereby transferring title and the right to possession of the real interests to the Petitioner as of the dates specified in the order.
Neither payment to the Respondents nor deposit into Court of the amount as stated above shall prejudice or affect the right of Respondents to contend for further payment in this proceeding.
