On Jan. 31, at approximately 11:30 p.m., Big Lake Police Officer Silas Reek stopped a vehicle for expired registration and crossing the fog line numerous times. The driver was identified as Jason Marshall, 37 of St. Cloud.
Officer Reek detected an odor of marijuana coming from inside the vehicle, along with an odor of alcohol emitting from Marshall’s breath. Reek observed a marijuana stem in the center cup holder. Reek also observed Marshall’s eyes to be red, bloodshot, and watery. Marshall’s movements were slow, and his speech was slow. Marshall admitted his drivers license was revoked and to having a shot or two of alcohol at his house prior to driving.
Officer Reek had Marshall perform standard field sobriety tests. Marshall showed multiple signs of impairment during each of the tests. Marshall tested under the legal limit for alcohol, so Officer Reek believed Marshall was under the influence of a controlled substance.
Officer Mikelson, who was also on scene and is a trained Drug Recognition Evaluator, noted Marshall’s eyes had little to no reaction to light consistent to drug impairment. Marshall also had pinpoint pupils. Marshall was placed under arrest for driving while impaired by a controlled substance. A digital scale with residue on it was found in Marshall’s pocket. The residue field tested positive for methamphetamine.
During the search of the vehicle, officers located a zip lock bag stuffed in-between the driver’s seat and center console. The zip lock bag contained a few pieces of paper towels and a white crystal substance. The substance field tested positive for methamphetamine and weighed 11.8 grams. Officers also located 2.5 grams of marijuana in the same area.
A search warrant for a blood or urine sample from Marshall was applied for and granted. Marshall was advised of the search warrant for a blood or urine sample and that refusal to provide one or the other was a crime. Marshall stated he was afraid of needles and would not provide a blood sample but would provide a urine sample. Marshall then changed his mind and stated he did not want to provide any samples.
Marshall was charged with; Felony 3rd Degree Possession of Narcotics, Gross Misdemeanor DWI Test Refusal, Gross Misdemeanor DWI, Gross Misdemeanor Driving After Cancellation-Inimical to Public Safety, and Misdemeanor Possession of Marijuana
