During their recent meeting, the Lynden Twp. board of supervisors discussed complaints, road updates and a CUP application.
Complaints
Dunmore Circle property owner Phillip Kramer has filed an appeal to the administrative citation he was issued in response to multiple complaints of his dogs running loose.
An appeal hearing was conducted Sept. 17, after which the township hearing officer filed to dismiss the citation as there wasn’t a willful disregard of the ordinance. Kramer was advised to keep his invisible fence in working condition and keep his dogs on his property unless leashed.
An inspection of the property located at 483 221st St. E. conducted Oct. 1 showed the tent and RV continue to be occupied and junk and garbage still remain. A motion carried authorizing the issuance of an administrative citation to Lake Central Bank, which is listed as the property owner.
Road Updates
Supervisor Dennis Niemi informed the board he had reviewed the request from Pilgrim’s Pride to haul up to 97,000 pounds of truck weight along 155th St. with a representative from the Stearns Co. Highway Dept. Their current procedure is to issue a permit per load with a load fee.
Niemi will follow up with Twp. Attorney Mike Couri to review the township’s options. The board continues to have concerns regarding the best way to guarantee the company would be required to pay to repair any damage to the roads.
Niemi provided the board with proposed summer and winter contracts for Schendzielos for review. A copy will also be provided to Couri; further discussion will be held at the November meeting.
CUP App.
Arevalo Transport LLC submitted an application for a CUP (conditional use permit) for a large trucking terminal on 202nd St. E. Because the property is partially located in shore land, Stearns Co. Environmental Services (SCES) is handling the application, but suggested the company contact the township as they are the road authority.
After reviewing the application, the board noted the property is served by a nine-ton road, however, the roads in that area are seven-ton roads and are posted as such in several places. The state has declared all roads to be nine-ton roads unless otherwise posted; the road has been posted as seven-ton for a number of years.
Arevalo informed the board they were advised the sign was incorrect, however, the board informed the company they must follow the weight restrictions on the posted signs.
Supervisor Anne Ackerman will follow up with SCES.
