August 20, 2021, at approximately 1:07 a.m., Officer Tim Mikelson stopped a vehicle for driving on the fog line. The driver was identified by Minnesota DL as Cherie Gieseke (Age 58 – Rockford).
Gieseke stated she, and her passenger, were coming from a cleaning business. However, this was inconsistent with Officer Mikelson’s earlier observations. Gieseke was nervous and avoiding eye contact. Gieseke was making quick movements and rapidly answering questions. Gieseke stated the vehicle belonged to her son. Officer Mikelson ran Gieseke’s information which showed a revoked drivers license and the vehicle registed to somone other than her son.
Officer Mikelson returned to the vehicle and asked for any documentation showing insurance or ownership of the vehicle.
Gieseke did not have any documentation. Officer Mikelson asked Gieseke if she has used any drugs or alcohol and asked if there was anything illegal in the vehicle. Gieseke denied both. Officer Mikelson asked Gieseke if he could search her vehicle and she stated, “Sure.”
Officer Mikelson searched the vehicle and located a black bag.
Inside the bag Officer Mikelson located a plastic baggie containing a white crystal substance. The substance later field tested positive for methamphetamine and weighed .2 grams.
Gieseke was read the Miranda warning and admitted the substance found in the black bag was methamphetamine and belonged to her. A plastic jar containing more white crystal substance was found in Gieseke’s purse.
Gieseke has two prior Felony Fifth Degree Controlled Substance convictions and a Felony Second Degree Controlled Substance conviction.
Gieseke was arrested and transported to the Sherburne County jail. Giseke was charged by criminal complaint with; Felony Fifth Degree Possession of Controlled substance, Misdemeanor Driving After Revocation.
