Notice of Enactment: The Town of Big Lake Board of Supervisors hereby ordains an ordinance relating to the regulation and registration of cannabis retail businesses and lower-potency hemp edible (LPHE) retail businesses (the “Town Ordinance”). The Ordinance identifies the findings, purpose, authority, and jurisdiction for regulating cannabis and LPHE retail businesses. The Ordinance adopts Sherburne County’s Ordinance 280 (the “County Ordinance”), which pertains to the regulation and registration of cannabis retail businesses and lower-potency hemp edible (LPHE) retail businesses. Sherburne County will administer and enforce the Town Ordinance and the County Ordinance. The Town Ordinance adopts the County Ordinance’s definitions; requirements for cannabis and LPHE retailers including advertising, price discounting, and access; and buffer distances and hours of operation for cannabis retailers. The Town Ordinance and County Ordinance require all cannabis and LPHE retailers in Big Lake Township to register with the County and set a limit on the number of cannabis retailers in the Town. For cannabis and LPHE retailers the County Ordinance sets forth the process for registration, renewals, suspensions, annual age and ordinance compliance checks, and other registration matters. The Town Ordinance adopts the prohibition of any sale by a cannabis or LPHE retailer to a customer or patient without a valid registration and a state license and authorizes a civil penalty with opportunity for an administrative hearing. It sets out civil remedies and civil or criminal penalties. The Town Ordinance is effective as of the date of passage on the 9th of April 2025. This is a summary of the Ordinance. This Ordinance was passed by the Big Lake Town Board of Supervisors on the 9th day of April 2025, and duly filed with the Sherburne County Attorney.
