Two Public Hearings Held After Lynden Township’s Monthly Meeting

Lynden Township had a short meeting Oct. 3, with two property splits and a variance application on their agenda. Two public hearings were held directly after the meeting, one concerning an alley vacation, and one to consider recertification of special assessments on a Fulton Circle property.
 
Property Splits
A purchase agreement has been signed for the north half of the 28.67 acre Nemeth Industrial property, approximately 14.6 acres. 
 
Wayne Elam was in attendance representing Nemeth Industrial Property seller Karen Nemeth. He informed the board he had discussed the proposed split with Stearns County and they consider it to be a minor plat as it creates only one additional building site. 
 
Due to the county’s determination, a motion was passed to waive the requirements for the township’s subdivision ordinance.
 
Frank Sherwood was in attendance representing Satellite Shelters, the business considering the purchase of the south half of the property. He informed the board Satellite Shelters doesn’t plan to erect any buildings on the site; they would instead use the property for storing portable construction site office trailers.
 
Supervisor Anne Ackerman informed Sherwood the planning commission and board had reviewed the inquiry and determined it would be a permitted use under the warehouse and distribution section of their ordinance. 
 
All requirements of the ordinance will need to be met, which includes implementation of an approved stormwater plan, constructing a 60/40 impervious surface, and installing a fence with at least 80% opaque screening around any outdoor storage. A vegetative buffer on the property line adjacent to the County Park was also discussed.
 
The board agreed a representative from Bogart-Pederson could produce a stormwater plan for the site.
 
Clerk Jenny Schmidt informed the board she had received an email regarding another parcel that was inquiring about a potential property split. The board directed the inquiry to Stearns County as the parcel lies partially in shoreland.
 
Variance Application
An Eaglewood Road property owner informed the board he would like to raise the roof of an existing garage to allow for camper storage. The board determined a variance might be needed from the setback from the township road if required by Stearns County.
 
No further action was deemed necessary until an application from the property owner has been received.
 
Other Business
The planning commission will be meeting Oct. 24 at 6 p.m.
 
The next Lynden Township meeting will be Nov. 7 at 7 p.m. 
 
Alley Vacation 
A public hearing was held directly after the meeting to consider a petition to vacate a portion of an alley, which was requested by William and Laurie Hallila. The petition includes an agreement to pay all associated costs and a waiver of damages. 
 
No interested parties were present, so the public input portion of the hearing was closed.
 
A motion to adopt Resolution 2016-11, a Resolution approving the vacation of a portion of an alley, was made and passed.
 
Special Assessment
A second public hearing was held to consider the proposed recertification of special assessments following tax forfeiture on a Fulton Circle property. 
 
Property owners Kevin and Sheri Turner agreed to pay the $18,490 special assessment with $3,000 down and the remainder to be paid at 3% interest over five years.
 
No interested parties were present, so the public input portion of the hearing was closed.
 
A motion to adopt Resolution 2016-12, a Resolution adopting reassessment of the special assessment on 3022 Fulton Circle, was made and passed.
