Jason Jerome Rothmeyer’s trial has been tentatively set for Sept. 9 after a pre-trial occurred this week at Sherburne County.

Rothmeyer of Clear Lake has officially been charged in Sherburne County with criminal vehicular homicide, fleeing police and drunken driving after a crash last year that caused the death of Kyle Foley of Dassel.

Rothmeyer is accused  was leaving Pebble Creek Bar & Restaurant Aug. 10, 2018 at around 7:45 p.m. An unidentified observer took note of an intoxicated male entering a vehicle in the parking lot of Pebble Creek Restaurant. That observer made a call to police and a BPD officer arrived on scene as the driver pulled onto Co. Rd. 23 (Sherburne Ave.) and neared Edgewood Street.

The police officer observed Rothmeyer swerving outside his lane. The officer attempted to stop him, but Rothmeyer sped away, running a stop sign and causing a collision that killed the 18-year-old man.

Rothmeyer’s blood alcohol level was reported as being nearly three times the legal limit for driving.
