During their meeting Tuesday night, the Clear Lake Twp. Board of Supervisors discussed updates on the 76th Street turn-around, including right-of-way obstructions that were discovered.
Twp. Engineer Terrance Vander Eyk told the board Bogart, Pederson had completed a site survey of the area and found a retaining wall and a well in the ROW, which are violations of state statute. The township wasn’t aware of the issue.
After speaking with their attorney, Supervisor Gary Gray indicated he would be meeting with the property owner to hopefully resolve the issue before any legal steps were taken.
Eyk presented two options for a hammerhead-type turn-around that is designed for a single unit truck. Class 2 surfacing was estimated at $5,380, bituminous surfacing was estimated at $8,030.
“This isn’t carved in granite, but it’s a safe place to turn around instead of using someone’s driveway,” said Gray. “Before we get close to going forward, I’ll meet with everyone out there.”
Road Report
Eyk informed the board sealcoating on the east side of Big Elk Lake was tentatively scheduled for the beginning of August.
An updated map of the Clear Lake Twp. Park will be completed by the end of the month and will be available on the township website.
Orderly Annex
The township met with the City of Clear Lake June 19 regarding orderly annexation; three of their council members and their attorney were in attendance. After reviewing the agreement, the city only had a few minor changes.
Gray said the agreement is split into three zones, which by state statute need to have acreage and population listed for each. Eyk was given the go-ahead to begin work on it; the city agreed to pay for half the expense.
Supervisor Bud Stimmler inquired as to who would be maintaining common roads. Gray said they would most likely do so, however, it was up for discussion and an agreement could be made with the city like the township has in place with Haven Twp.
The orderly annexation agreement will be voted on at the city council’s next meeting in August. Gray noted the agreement can be amended at any time by either party.
A motion carried approving the joint resolution for orderly annexation with the City of Clear Lake.
New Business
Gary Gohman approached the board to inquire why some of the survey points on his property may have been removed and asking the township to replace them. He asked about construction or reconstruction work that had been done on the road over the years.
Gray informed him the earliest survey they were able to find was from 1977 so they’re assuming the road was constructed around that time. The board indicated they wouldn’t replace the irons as they didn’t know what actually occurred that caused them to be removed.
“I sympathize with you that they’re not there,” said Gray. “But we’re can’t set a precedence, or everyone will ask us to do it.”
Terrance Kurowski approached the board to request a 14’ setback variance for an existing deck, which is classified as a legal, non-conforming structure and was already in place when he purchased the property. The variance is necessary before he can build a 24’ x 40’ garage. Seeing no issues, a motion carried to send favorable comments to the county.
A motion carried allowing Gray to sign all agreements for the Hartkopf property annexation.
Other Business
Eyk recommended the township purchase two subscriptions to Beacon, one for himself and one for the clerk, as the additional information available makes it worthwhile.
Gray told the board the company proposing a solar farm on Co. Rd. 8 submitted a name change but if anything else has changed they’ll need to come back to the township for approval.
Gray informed the board the fire department advisory board approved the purchase of turnout gear and a special ‘washer/dryer’ system that will remove all the toxins from them.
Stimmler told the board he was working with the county on a possible burn on the east side of the park where Siberian Elm are attempting to take over.
The sheriff reported 55 incidents for June, including 11 traffic, four medicals, one DUI, one theft, one boating complaint and one warrant arrest.
The next Clear Lake Twp. meeting will be Aug. 20 at 7 p.m.
