A public hearing on a petition to vacate a portion of Highland Dr. in the plat of Shores Point was held before the regular Lynden Twp. August meeting. The petition was submitted by Anne Ackerman and Eric Wilcox and includes an agreement to pay costs associated with the road vacation and waiver of damages.
Ackerman explained the request to vacate the road will allow the two property owners to continue to use the property as they have been doing, clear up the defacto ownership so it can be placed on the tax roll, and generate income. The property will remain in a natural state; a portion will be retained by the township to allow snow placement.
With no public input the hearing closed. After reviewal, a motion carried adopting Resolution 2021-04 Petition to Vacate a Portion of Highland Dr. in the Plat of Shores Point. Total cost for the process is pending; Ackerman submitted $1,000 to be held in escrow until the final expense determination is made.
Road Updates
Supervisor Dennis Niemi informed the board he is compiling traffic count information on 200th St. and 6th Ave. He recommended soil boring and advertising for quotes on tarring. Deputy Treasurer Dan Torgersen questioned assessment payments from residents living along the road pursuant to the tarring policy, such as what occurred for Eaglewood Rd.; Chairman Dave Johnson stated that determination on whether or not to proceed with tarring hasn’t yet been made.
Niemi will obtain written quotes for repairing 200th St. from 21st Ave. to Co. Rd. 44.
A motion carried to order and erect approximately twelve 30 mph speed zone signs along Dunmore Circle to comply with Resolution 2006-01 establishing a 30-mph zone
CUP Request
Jack and Carol Kritzeck approached the board to request a certificate of compliance for their Franklin Rd. parcel. They own 52.6 acres and plan to convey the 2.8-acre parcel across I-94 from the farm site to an adjoining property owner as an attachment to their property.
They also plan to create a 25-acre parcel of the vacant land south of I-94, create a 23.5-acre parcel that consists of the farm site and land south of it, and create a 35.3-acre parcel from the remaining land. Stearns Co. has determined it to be an administrative split.
A motion carried to issue a CUP as described in the provided survey and allow the chair and clerk to sign the document outside of a regularly scheduled meeting once updated legal descriptions have been added.
Rezone Request
James Klaverkamp approached the board to request a rezoning a portion of his 40-acre parcel along Co. Rd. 44. The south 30 acres to be rezoned R-10 with three building entitlements; the north 10 acres to remain A-40 with one building entitlement.
Johnson requested the Planning Commission meet to review the request and make a recommendation in order to remain consistent with Lynden Twp.’s comprehensive plan among other considerations.
Other Business
A motion carried allowing Planning Administrator James Kantor to reach out to Lagrave to submit a CUP application.
The sheriff reported around 100 calls for the month of June, mostly from Warner Park, and one boat theft. A dog bite on Alder Rd. led to the dog being deemed potentially dangerous. Johnson requested additional speed enforcement on Dunmore Cr.
The next Lynden Twp. meeting will be Sept. 7 at 7 p.m. due to the Labor Day holiday.
Lynden Twp.’s recessed annual meeting will be held on Sept. 16.
