THIS SUMMONS IS DIRECTED TO THE ABOVE-NAMED DEFENDANTS:

  1. YOU ARE BEING SUED. The Plaintiffs have started a lawsuit against

The Plaintiffs' Complaint against you is on file in the office of the Court Administrator of the above-named Court. Do not throw these papers away. They are official papers that affect your rights. You must respond to this lawsuit even though it may not yet be filed with the Court and there may be no Court File Number on this Summons.

  1. YOU MUST REPLY WITHIN 20 DAYS TO PROTECT YOUR RIGHTS. You must give or mail to the person who signed this Summons a written response called an Answer within 20 days of the date on which you received this Summons. You must send a copy of your Answer to the person who signed this Summons located at:

  1. YOU MUST RESPOND TO EACH CLAIM. The Answer is your written response to the Plaintiffs' Complaint. In your Answer you must state whether you agree or disagree with each paragraph of the Complaint. If you believe the Plaintiffs should not be given everything asked for in the Complaint, you must say so in your
  1. YOU WILL LOSE YOUR CASE IF YOU DO NOT SEND A WRITTEN RESPONSE TO THE COMPLAINT TO THE PERSON WHO SIGNED THIS SUMMONS. If you do not answer within 20 days, you will lose this You will not get to tell your side of

  1. ALTERNATIVE DISPUTE RSOLUTION. The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice. You must still send your written response to the Complaint even if you expect to use alternative means of resolving this
  1. THIS LAWSUIT MAY AFFECT OR BRING INTO QUESTION TITLE TO REAL PROPERTY located in the County of Sherburne, commonly known as 28110 14l51 Street NW, Zimmerman, Sherburne County, Minnesota, and legally described as:

All that part of Government Lot 1, Section 31, Township 35, Range 26, Sherburne County, Minnesota described as follows:

Commencing at a point located on the South line of Government Lot 3, Section 31, Township 35, Range 26 and its intersection with the Easterly shore  line  of  Elk  Lake; thence East along said South line of Government  Lot 3 a  distance  of 293.5 feet more or  less to a point; thence North 39 degrees 55 minutes east a distance of 244.6 feet to an iron pipe; thence North 62 degrees 36 minutes East a distance of 40 feet to the point  of  beginning of this description; thence North 52 degrees 38 minutes  East  a distance  of 40 feet to an iron pipe; thence North 34 degrees 46 minutes West  a distance  of 207.8  feet  more or less to the Easterly shore line of said Elk Lake; thence Southwesterly along said shore line a distance of 68 feet more or less; thence South 41 degrees 45minutes East a distance of 174.4 feet more or less to the point of beginning; and

All that part of Government Lot 3, Section 31, Township 35, Range 26 described as follows: Commencing at a point located on the South line of Government Lot 3, Section 31, Township 35, Range 26 and its intersection with the Easterly shore line of Elk Lake thence East along said South line of Government Lot 3 a distance of 293.6 feet more or less to a point; thence North 39 degrees 55 minutes East a distance of 244.6 feet to an iron pipe; thence North 62 degrees 38 minutes East a distance of 50 feet to the point of beginning of this description; thence North 62 degrees 38 minutes East 50 feet thence South 41 degrees 45 minutes East 100 feet more or less thence South 62 degrees 38 minutes West 56 feet more or less thence North 41 degrees 45 minutes West 136 feet to the point of beginning, Sherburne County, Minnesota.

(referred to as the "Subject Property").

The purpose of this action is to obtain an Order for following relief:

  1. Determining, adjudging, and decreeing that Plaintiffs are the owners in fee of the Subject Property, legally described in the above-cited New Legal
  1. Determining, adjudging, and decreeing that the Defendants, or anyone claiming through them, have no right, title, interest, estate or lien upon the above-described Subject Property.
  1. For such other and further relief as is deemed just and equitable by the

557.03 NOTICE OF NO PERSONAL CLAIM:

Pursuant to Minn. Stat. § 557.03 you are hereby served with notice  that  no  personal  claim  is made against you and that any Defendant upon whom this notice is served who unreasonably defends this action shall pay full costs to the Plaintiffs.
