ORDER AND NOTICE OF HEARING ON PETITION FOR FORMAL PROBATE OF WILL AND FORMAL APPOINTMENT OF PERSONAL REPRESENTATIVE AND NOTICE TO CREDITORS (Formal- Unsupervised).
It is ordered and notice is given that on October 27th, 2023, at 9:30 a.m., a hearing will be held in this Court at 13880 Business Center Drive NW, Elk River, Minnesota, for the formal probate of an instrument purporting to the Will of Decedent, dated December 3, 2014, (“the Will”), and for the appointment of John Champa, whose address is 305 Central Avenue SW, Chisholm, MN 55719, as Personal Representative of Decedent’s estate in an unsupervised administration.
Any objections to the petition must be filed with the Court prior to the hearing or raised at that hearing. If proper, and if no objections are filed or raised, the Personal Representative will be appointed with full power to administer the estate including the power to collect all assets, to pay all legal debts, claims, taxes and expenses, to sell real and personal property, and to do all necessary acts for the estate. If you have an objection to the case, please contact Court Administration at 219-305-7021 for further instructions as these hearings are currently held remotely due to the pandemic.
Notice is also given that subject to Minnesota Statute section 524.3-801, all creditors having claims against the estate are required to present the claims to the Personal Representative or to the Court Administrator within four (4) months after the date of this Notice, or the claims will be barred.
