HAVEN TOWNSHIP
SHERBURNE COUNTY, MINNESOTA
This Ordinance repeals Haven Township Ordinance No. 2012-2.
By a letter dated May 15, 2019, the Haven Town Board was informed by the Minnesota Pollution Control Agency that Haven Township is no longer subject to the MS-4, and NPDES/SDS Permit Requirements.
The Board has determined that Ordinance No. 2012-2 is no longer needed. At its May 20, 2019 regular Town Board Meeting, the Board voted unanimously to repeal Ordinance No. 2012-2.
THEREFORE, Haven Township Ordinance No. 2012-2 is repealed upon publication of this Ordinance.

The City of Clear Lake is applying for a construction loan under the Minnesota Department of Health (MDH) drinking water revolving fund program and is, therefore, subject to the state environmental review process. This notice is to advise the public that MDH staff has reviewed the proposed project and has determined that preparing an Environmental Assessment Worksheet is not required.
The loan applicant has solicited public comment on potential environmental consequences. After reviewing any comments received we conclude that construction and project implementation will lead to no significant environmental impact.
The environmental summary included with this notice provides information on the existing and proposed drinking water infrastructure and associated environmental considerations. If there are comments about this environmental review process, they must be received within 15 days. They should be submitted to:

ENVIRONMENTAL SUMMARY

Present Water System and Need:
The City of Clear Lake currently has a treatment plant (TP) that treats well water for elevated nitrate levels. The TP is supplied by Wells 1 & 2. Well 1 has nitrate levels above the MCL and must be blended with water from Well 2 to meet water quality standards. Additionally, a recent study suggests the nitrate plume may be traveling towards Well 2.
The proposed project includes drilling a new well and constructing an associated Water treatment facilities to meet water quality standards for nitrates in the City of Clear Lake's drinking water.
ENVIRONMENTAL IMPACTS
The primary impacts of the projects are the short-term construction related disturbances such as dust and noise. The short-term impacts will be mitigated by the use of standard construction practices. Effective soil erosion and dust control measures will be carried out as often as necessary to prevent any dust or erosion that may be damaging to property, area vegetation, wildlife, adjacent lands, surface water bodies, or may cause a nuisance to persons in the vicinity.
The project has potential to impact the habitats of the Blanding's turtles and the loggerhead shrike, which are a state-listed threatened species.
Measures will be taken to minimize the impact on the Blanding's turtle's habitat, which include but are not limited to: use of "Natural Netting" for erosion and sediment control; providing information to workers about the turtle; and minimizing disturbance to natural terrain and native landscape as much as possible.
Measures will be taken to minimize the impact on the loggerhead shrike's habitat, which include but are not limited to: shrub and tree removal will be avoided when feasible during the breeding season (April through July). If construction schedule dictates shrub or tree removal during the breeding season, shrubs and trees will be inspected before they are removed. Additionally, any loggerhead shrike sightings will be reported to the DNR.
The project is not expected to result in any direct impacts (other than those list above) to: threatened or endangered plant or animal species or their habitats; wetlands; flood plains; nearby farmland; historic, architectural, cultural, or archaeological features; shore lands; or air quality non-attainment areas.
PUBLIC PARTICIPATION PROGRAMS
The City of Clear Lake published the environmental review public notice in the local newspaper on January 12, 2019; January 19, 2019; January 26, 2019; February 2, 2019; and February 9, 2019. Additional notices were sent out to the City of Clear Lake on January 17, 2019. Comments were to be submitted by February 18, 2019 for consideration. The one comment received was addressed in the Environmental Review.
