NOTICE OF PUBLIC HEARING
Notice is hereby given that the City of Becker Planning Commission will hold their monthly meeting at 6:00 p.m. on Monday, June 24th, 2019 at the Becker City Hall, 12060 Sherburne Avenue.  The Planning Commission will hold the following public hearing at this meeting:
Approximately 6:00 p.m.: Public Hearing for a Temporary Concrete Batch Plant. Amcon Concrete Products, owner and Cemstone Products Company, applicant, has submitted an application for a Conditional Use Permit for the property located at 11300 125th  Avenue SE and legally described as: The Southly 550.00ft of the NE ¼ lying Westerly of and abutting Westerly ROW line of County Highway 52 (125th Avenue S.E.) Becker, Sherburne County, Minnesota to allow for a temporary concrete batch plant to be located on the above described property.

THAT pursuant to said Declaration, there is claim to be due and owing as of May 30, 2019, from title holder Christopher B. Wamsley and Jennifer M. Wamsley, husband and wife, the amount of $4,341.19 representing assessments, late fees and collection costs, plus additional assessments and other amounts that may have accrued since the date of this notice, including the costs of collection and foreclosure;
THAT prior to the commencement of this foreclosure proceeding, Lienor complied with all notice requirements as required by statute; that no action or proceeding has been instituted at law or otherwise to recover the debt secured by said lien, or any part thereof;
THAT the owner has not been released from his financial obligation to pay said amount;

Wamsley and Jennifer M. Wamsley, husband and wife;
THAT pursuant to the power of sale granted by the owners in taking title to the premises subject to said Declaration, said lien will be foreclosed by the sale of said property by the sheriff of said County at the Sherburne County Sheriff’s Office located at 13880 Business Center Drive NW, Suite 100, Elk River, MN 55330, on July 31, 2019, at 10:00 a.m., at public auction to the highest bidder, for cash, to pay the amount then due for said assessments, together with the costs of foreclosure, including attorneys’ fees as allowed by law. The time allowed by law for redemption by the unit owners, their personal representatives or assigns is six (6) months from the date of said sale.

The default upon which foreclosure is based is the failure to pay the remaining balance of the principal indebtedness, accrued interest, and late charges secured by the mortgage following acceleration pursuant to section 9(a)(i) of the mortgage ("The borrower dies and the Property is not the principal residence of at least one surviving borrower"), in the total amount of $184,912.58 as of March 6, 2019.

Any heir, devisee or other interested person may be entitled to appointment as personal representative or may object to the appointment of the personal representative.
