Regular Agenda
2023 Farm Family of the Year and Receive a University of MN Extension Update. Administration

University of Minnesota Regional Director Lori Vicich recognized the 2023 Farm Family of the Year to the Imholte Family of Clear Lake. The Board also received a University of MN Extension update from the four Quad-County Extension Educators.

County Administrator acknowledged why the flags are at half-staff for Pearl Harbor Recognition, reminded the Board of the County Holiday lunch on Friday, December 8 and announced and extended congratulations to Chair Fobbe on her recent appointment as the Association of Minnesota Counties Secretary and Treasurer.

Preliminary and Final Simple Plat of Maciej Acres - Carol Maciej. Planning & Zoning

Felber/Gray were unanimous to approve the requested Residential Preliminary and Final Simple Plat for “Maciej Acres” consisting of (1) lot, with the following (4) Conditions as recommended by the Planning Commission, for PID #15-012-2100; Legal Desc: E ½ of NW ¼ (full legal on file); Sec 12, Twp 35, Rge 27, Blue Hill Township; with 148.82 acres in the General Rural District and within the General Watercourse District of Battle Brook.
Conditions:
1. Park dedication fees for one (1) lot is $1,200. Park fees must be paid prior to the Public Works Dept signing the plat mylars.
2. A new legal description will need to be prepared, approved, and recorded at the same time as the plat for the remnant piece (143.27 +/- acres).
3. An Access Permit is required to be taken out from the Public Works Department to ensure construction according to the County Standards.
4. The plat shall be recorded in the Office of the County Recorder/Register of Titles, subject to recording fees, within one year of County Board approval of Final Plat.
Rezoning Request from General Rural to Industrial - Capital Land Group. Planning & Zoning

Hulse/Danielowski were unanimous to approve the rezoning of 48.95 acres from General Rural to Industrial, as recommended by the Planning Advisory Commission and with the recommended Findings, for PID # 30-027-3300, # 30-027-3301, # 30-027-3302, # 30-027-3300, and # 30-028-4410; Legal Desc: All That Part of the SW 1-4 (full legal on file); Sec 27 and 28, Twp 34, Rge 26, Livonia Township; with 48.95 acres in the General Rural District.
Findings:
1. Is the proposed rezoning consistent with the Comprehensive Plan?
The 2040 Comprehensive Plan has this property identified for Business and Industry, yes the proposed rezoning is consistent with the new Comprehensive Plan.
2. Is the current use of the property a permitted use within the proposed zoning district, or will the rezoning create a nonconforming use? The property currently has an interim use permit for mining. Mining is not allowed as a permitted use in the requested zoning district, but is allowed with the issuance of an interim use permit. A non-conforming use will not be created.
3. Will permitted uses within the proposed zoning district be injurious to health or interfere with the comfortable enjoyment of life or property within the vicinity? The current land use permit for the parcels requires that they be restored to open space for woodlands and waterbodies following the completion of gravel mining. After successful restoration of the land, the permitted uses in the proposed zoning district such as
mini storage, manufacturing, small and medium contractor’s yards and warehousing may not be injurious to neighboring properties given the high walls that will surround the property once it is restored. Applicant’s rezoning request is not made specifically for a use that requires environmental review before the use may be permitted.
4. How will public services (e.g. transportation, schools, parks, and police/fire) be impacted by the proposed rezoning? Will permitted uses within the proposed zoning district adversely impact or overburden existing public service capacity? It is not anticipated that the permitted uses within the proposed rezone will adversely impact public services. The Zoning Ordinance generally provides necessary performance standards for the permitted uses listed in the Zoning District to ensure that
public road is approved by the local road authority to address potential transportation issues.
5. Is the proposed rezoning located in an area that has the potential to adversely impact natural resources such as surface water, groundwater, or wetlands, or sites identified for rare biological species habitat? Yes, there is a Natural Environment Lake (Rice Lake) with a known contamination plume originating from the existing landfill. The permitted uses and uses allowed through Interim and Conditional Use permits in the Industrial district have the potential to adversely impact natural resources in the area.
6. Does the proposed rezoning have the potential to impact ecologically sensitive or historically significant areas? Yes, there is a natural environment lake located adjacent to the property, wetlands located on the property, and the subject property is located within the Anoka Sand Plains. The permitted uses and uses allowed through Interim and Conditional Use permits have the potential to adversely impact ecologically sensitive resources in the area. There are no known historically
significant areas.
7. Does the property have sufficient size and physical characteristics to permit a reasonable use under the current zoning district? Yes, the parcels have sufficient size and characteristics to allow for reasonable uses, and are currently permitted for gravel mining.
8. Any other factors that may be relevant to determining whether the proposed rezoning is appropriate? The Sherburne County 2040 Comprehensive Plan identified the need for additional lands along US Hwy 169 for Business and Industry the Applicant’s Rezone aligns the adopted Future Land Use Map.
Interim Use Permit for Mining (Peat) - Merlin Valerius.

Felber/Gray were unanimous to approve an Interim Use Permit for Merlin Valerius for Mining (Peat), and the Revocation of the existing IUP (#66282, Doc # 919310) with the following (8) Conditions and Findings of Fact, as recommended by the Planning Commission, for PID #30-028-1400; Legal Desc: SE ¼ of NE ¼ subject to Easement Desc as (full legal on file); Sec 28, Twp 34, Rge 26. Livonia Township; with 41.4 acres in the General Rural District and within the Tributary Stream District of Tibbits Brook.
CONDITIONS:
1. The applicant agrees to revoke Interim Use Permit Number 66282, Recorded Document Number 919310 for Mining upon recording the current Interim Use Permit for Mining and pay the separate recording fee of $46.00.
2. This Interim Use Permit shall expire on October 10, 2027.
3. All erosion control measures outlined in the applicants SWPPP must be established and maintained.
4. The days and hours of operation will be Monday – Friday 7:00 AM to 6:00 PM, Saturdays 7:00 AM – 2:00 PM.
5. No excavation allowed outside the designated mining areas identified on Proposed Mining Site Plan, Packet Attachment D.
6. The property owner shall permit the county to inspect the property.
7. The applicant shall comply with all local, state and federal laws.
8. The applicant must maintain a valid Wetland Conservation Act Certificate of Exemption for this project and comply with 9 conditions of the no loss permit. Failure to maintain this exemption or comply with the conditions of this permit will invalid the Interim Use Permit.
Findings:
1. That the Interim Use will not be injurious to the use and enjoyment of other property in the immediate vicinity for the purposes already permitted, nor substantially diminish and impair property values within the immediate vicinity. Yes, the applicant has been mining peat from this property since 2013 and the proposed mining activity will be consistent with past operations which have not generated any complaints or violations of the permit.
2. That the establishment of the Interim Use will not impede the normal and orderly development and improvement of surrounding vacant property for uses predominant in the area. Yes, the establishment of this permit will not impact development of surrounding vacant properties. The work is temporary and only involves excavating and removing materials from this parcel. This IUP should have no impact on the development of neighboring land.
3. That adequate utilities, access roads, drainage and other necessary facilities have been or are being provided. Yes, the site has been mined for peat since 2014 and has demonstrated the property has adequate utilities, access to road, and proper drainage.
4. That adequate measures have been or will be taken to provide sufficient off-street parking and loading space to serve the proposed use. Yes, the low volume of truck traffic during the winter months and the adequate space on site for loading and parking.
5. That adequate measures have been or will be taken to prevent or control offensive odor, fumes, dust, noise and vibration, so that none of these will constitute a nuisance, and other lights in such a manner that no disturbance to neighboring properties will result. Yes, the applicant’s past practice and proposal to keep things the same has established that this interim use will not create a nuisance to neighboring properties.
Final Standard Plat for Meadow Estates North - Dan Berning, Ziegler Custom Homes. Planning & Zoning

Conditions:
1. The Sherburne County Public Works Department will require park dedication fees for the six (6) new lots at $1,200 per lot, totaling $7,200. Park fees must be paid prior to the Public Works Department signing the plat mylars.
2. A copy of the NPDES permit for this project must be submitted to the Zoning Department prior to being placed on the agenda for final plat approval. (Completed)
3. A Stormwater and Erosion Control Permit application is required to be submitted to the Zoning Department prior to recording of the plat. (Completed)
