CITY COUNCIL CITY OF CLEARWATER ORDINANCE NO. 2021-04 AMENDING CHAPTER 34 ARTICLE III OF THE CLEARWATER CITY CODE

THE CITY OF CLEARWATER HEREBY ORDAINS AS FOLLOWS:

City Code Part 1, Chapter 34, Article III – Parking is hereby amended as follows:

Section 34-62 – Impoundment is amended as follows:

Any vehicle in violation of this article is declared to be a nuisance. A police officer may summarily abate a nuisance vehicle by removing said vehicle and storing the same in an appropriate place or directing or requesting another person to remove said vehicle and store in an appropriate place. The registered owner shall pay all the administrative, towing, and storage fees along with the fines imposed by the city

before the registered owner shall be permitted to recover said vehicle. The Public Works Supervisor or designee may also direct removal of vehicles or other equipment but only after a snowfall and when in violation of Section 34-66.

Section 34-66 - Parking after snowfall is amended as follows:

After a snowfall of at least two inches or a wet slushy snowfall of any amount, it is a petty misdemeanor for any person to fail to remove a motor vehicle or parts thereof from any street or alley until the snowplowing on the street or alley is completed.

Following any snowfall between the dates of November 1 st of each year to April 1st of the year next following, it shall be unlawful to park or leave standing any vehicle or part thereof on any City street or alleyway from 2:00 a.m. until such time as snow plowing curb-to-curb has been completed on such street or alleyway. All vehicles or

parts thereof found in violation may be towed at the owner’s expense at the direction of the Public Works Supervisor or designee. Any vehicles towed under this provision shall follow the procedures outlined in Section 34-62.

This parking prohibition includes parking vehicles or part thereof on the street or right of way, whether improved with curb, gutter and pavement or not improved.

Section 34-67 - Removal of snow, ice or rubbish from public sidewalks is added as follows:

The owner and the occupant of any property adjacent to a public sidewalk shall use diligence to keep such sidewalk safe for pedestrians regardless of whether the sidewalk is located in front of a boulevard, directly in front of the property, or within the street right of way. No such owner or occupant shall allow snow, ice, dirt, or rubbish to remain on the sidewalk longer than twenty-four (24) hours after its

deposit thereon. Failure to comply with this section shall constitute a violation.

The city may levy a fee against the property owner in accordance with the current Fee Schedule Ordinance to cover the city’s costs to cure public safety violations in this section. Such fees constitute a lien against the property and may be assessed to property taxes if unpaid.

Section 34-68 - Pushing Snow onto a public right-of-way or roadway is added as follows:

In accordance with Minnesota Statutes, property owners or occupants are prohibited from depositing snow on a public right-of-way or roadway. This includes pushing snow across the roadway onto an adjacent property.

Section 34-69 – Mailboxes is added as follows:

Property owners or occupants are responsible for shoveling snow from around their mailboxes to ensure delivery of mail.

Effective Date. This ordinance shall be in full force and effect upon its passage and summary publication, which is hereby authorized by the City Council.
