April 27 at approximately 2:18 a.m., Officer Tyler Hecht stopped a vehicle for illegal window tint. The driver was identified as Joshua Theis, 31 of Bemidji. Theis admitted he did not have a driver’s license.
While speaking to Theis, Officer Hecht observed Theis had bloodshot/watery eyes. Theis denied alcohol or drug use but admitted to smoking a THC dab pen a day prior. Officer Hecht advised Theis to step out of the vehicle so he could administer field sobriety tests.
While outside the vehicle, Officer Hecht detected an odor of marijuana emitting from Theis’s person. Officer Chaffee arrived and detected the odor of marijuana coming from inside the vehicle. Theis passed the field sobriety tests, but denied any illegal items were in the vehicle except for a THC dab pen in the center console.
The vehicle was searched and a zip lock baggie containing a white crystal substance was found by the driver’s floor mat. The substance field tested positive for methamphetamine and weighed 2.8 grams. Marijuana shake was also found on the floorboard, and a dab pen was found in the center console.
Theis was arrested and transported to the Sherburne County Jail. Theis was charged by criminal complaint with; Felony 5th Degree Possession of Narcotics and Misdemeanor Driving After Revocation.
