RESOLUTION TO REVERT FROM COMBINED OFFICE OF AUDITOR-TREASURER TO SEPARATE OFFICES OF COUNTY AUDITOR AND COUNTY TREASURER

Resolution No. 021726-AD-3270

WHEREAS, the Sherburne County Board of Commissioners previously adopted an optional form of government under Minnesota Statute 375A.10, combining the offices of County Auditor and County Treasurer into a single elective office; and 

WHEREAS, pursuant to Minnesota Statute 375A.1205 Subd. 2., the current Sherburne County Auditor-Treasurer has notified the County Board in writing that they will not be filing for another term; and

WHEREAS, Sherburne County has benefited from many years of dedicated and highly professional public service from both the elected and appointed officials serving in this Office; and

WHEREAS, Minnesota Statute 375A.12, Subd. 6 provides that any optional plan or change may be abandoned by following the same procedures required for its original adoption; and 

WHEREAS, more than three years have passed since the adoption of the combined office; and 

WHEREAS, the Board of Commissioners finds it in the public interest to return to separate offices due to the increasing span and complexity of statutory and regulatory duties prescribed to these offices, as well as to ensure robust segregation of duties, strong checks and balances, and improved administrative efficiency.

NOW, THEREFORE, BE IT RESOLVED by the Sherburne County Board of Commissioners that the County hereby abandons the combined office of Auditor-Treasurer and re-establishes the separate offices of County Auditor and County Treasurer.

BE IT FURTHER RESOLVED THAT, pursuant to MN Statute 375A.10 Subd. 5., this proposal must be approved by at least 80 percent of its members.

BE IT FURTHER RESOLVED THAT this change in County Offices shall take effect upon the expiration of the current term of the incumbent Auditor-Treasurer, or as otherwise provided by law. 

This resolution shall take effect immediately upon adoption and shall remain in effect until rescinded or modified by the County Board.
