An Ordinance Rezoning Property Located at 15794 County Road 50, Big Lake From Agriculture (AG) to Commercial (COM)
The Becker Joint Planning Board so ordains:
Section 1.
The Official Becker Joint Planning Board Zoning Map shall be amended as follows:
The East 5 acres of that part of the Southeast Quarter of the Southeast. Quarter of Section 15, Township 33, Range 28, Sherburne County, Minnesota, that lies southwesterly of the Burlington Northern Railroad right of way. Together with an easement for driveway purposes over and across the existing cartway located on that part of the East Half of the Northeast Quarter of Section 22, and the West Half of the Northwest Quarter of Section 23, all in Township 33, Range 28, lying northerly of a line drawn parallel with and a distance 125 feet southerly as measured at right angles from southerly right of way of the Burlington Northern, Inc.
Except:
That part of the Southeast Quarter of the Southeast Quarter of Section 15, Township 33 North. Range 28 West of the Fourth Principal Meridian, Sherburne County, Minnesota, described as follows:
A 25.00 foot wide strip of land, lying southwesterly of and being coincident with the following described line:
Commencing at the southeast corner of the Southeast Quarter of said Section 15; thence North 89 degrees 03 minutes 26 seconds West along the southerly line of the southeast Quarter of said Section 15, for a distance of 245.37 feet to a point of intersection with the southwesterly right-of-way line of the Burlington Northern Santa Fe Railway Company, said right-of-way line being 50.00 feet southwesterly of the centerline of the existing Burlington Northern Santa Fe Railway Company railroad track; thence North 48 degrees 08 minutes 15 seconds West along said right-of-way line, for a distance of 89.33 feet to the true point of beginning of the line to be described; thence continue North 48 degrees 08 minutes 15 seconds West along said right-of-way line for a distance of 700.00 feet; said line there terminating.
Shall be rezoned Commercial (COM) from Agriculture (AG).
Section 2. Effective Date.
This ordinance shall become effective upon its passage and publication.
